We offer giveaways at times. Participation in these giveaways is subject to the following general terms and conditions.

1. Giveaways and organizer

The organizer of the giveaways is LS Fashion Berlin GmbH (hereinafter "Organizer").
 
Participation is governed exclusively by the following terms and conditions.

2. Participation

a) Any natural person over the age of 18 is eligible to participate. However, employees of the Organizer and their direct relatives are excluded from participation.

b) Participation is only possible during the period described in detail therein.

c) Participation is of course completely free of charge and does not require the purchase of any goods or services.

d) Participation is dependent on the complete fulfillment of the conditions described in more detail within the giveaways. Only such participations can be considered within the giveaways. Incorrect information or incomplete participations cannot be considered. The organizer cannot be held responsible for late or incomplete participations.

e) By participating in the respective giveaways, the consenting party agrees to these terms and conditions.

3. Implementation

a) The prize described in more detail within the specific giveaways will be drawn from among all valid participations.

b) The promotion starts on the respective publication date and ends on the date specified on the promotion page.

c) The winner will be drawn on the working day after the end of the giveaway and notified by Instragam-DM or by e-mail; the winner must confirm receipt of the prize notification and the claiming of the prize within two weeks of the prize notification by the contact method specified within this notification. If this confirmation is not received, the prize will be awarded to another participant.

d) The claim to the prize shall also lapse if the prize cannot be sent within four weeks of the first notification of the prize for reasons for which the winner is responsible.

e) The claim to the prize cannot be assigned and is not transferable; furthermore, the prize cannot be paid out, supplemented or changed. If the prize cannot be made available, for whatever reason, the organizer reserves the right to award a substitute prize of equal value. The organizer is released from all obligations upon delivery of the prize.

The organizer shall only be liable for defects of title and quality in the event of intent or gross negligence.

4. Exclusion of participation

a) In the event of a breach of these terms and conditions, the organizer reserves the right to exclude participants from the giveaways.

b) Furthermore, the organizer reserves the right to exclude participants who use unauthorized aids or otherwise obtain advantages through manipulation, for example through collective or multiple participations. This is the case if, for example, automatic scripts, hacking tools, Trojans or viruses are used, or if a participant gains an advantage through other unauthorized means. Furthermore, untrue personal data, as well as the use of "fake profiles" can lead to exclusion. In such cases, winnings may also be subsequently withdrawn and/or reclaimed.

5. Premature termination or cancellation of the giveaways

The organizer reserves the right to cancel or terminate the giveaways at any time without prior notice. The organizer shall make use of this option in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper execution of the competition cannot be guaranteed. If such termination was caused by the behavior of a participant, organizer may claim compensation from this person for the damage incurred.

6. Instagram

a) The giveaway is not connected to Instagram and is in no way sponsored, supported or organized by Instagram.

b) Participants do not have any claims against Instagram arising from participation in the giveaways or by winning in the giveaways.

c) Inquiries and notices by the participants are to be directed exclusively to the organizer and not to Instagram.

7. Data privacy

The organizer collects and uses the personal data of the participants exclusively within the legally permissible scope. For details on the type and scope of data processing, please refer to our detailed privacy policy.

The responsible party or responsible person within the meaning of the BDSG or the DSGVO is the organizer of the giveaway:

If you participate in one of the giveaways of the organizer, the following personal data will be collected by the organizer:

• First and last name
• Date of birth
• Your postal address
• Your e-mail address

These data are used by the organizer exclusively to determine the winner, to check compliance with these terms and conditions, and to send the prize. The data processing is accordingly based on Art. 6 para. 1 lit. b) DSGVO.

8. Exclusion of liability for user contributions

The organizer is not liable for any legal violations by user contributions. We undertake to behave in a legally compliant manner, i.e. in particular do not contain insults or false statements of fact or violate intellectual property rights.

9. Final provisions

a) These terms and conditions and the entire legal relationship between the participants and the organizer are subject exclusively to the laws of the Federal Republic of Germany.

b) Should any of these provisions be or become invalid, this shall not affect the validity of the remaining provisions.

c) Legal recourse is excluded.
